31.  Members were reminded to make any declarations of personal and/or prejudicial interest that they may have in relation to items on the agenda.

MINUTES

 

33.  Resolved – That the minutes of the meeting held on 13 July 2009 be approved as a correct record and that they be signed by the Chairman.

 

 

MATTERS ARISING

 

Ford Eco-town (minute 26/2009)

 

34.  The decision of the Housing Minister formally announced on 16 July 2009 not to include Ford in the Government’s Eco-town programme, was welcomed.

 

35.  The Chairman advised that the District Council’s Local Development Framework Sub-Committee was meeting that day to consider a report commissioned from independent consultants, Barker Associates, which identified sites within the Arun District which might be suitable for housing development.  Amongst the sites identified, the report included a proposal to build a 5000 dwelling eco-town at Ford from 2022.  The Clerk had written to the Chief Executive on behalf of the Parish Council urging the LDF Sub-Committee to reject this proposal at the outset and not undo all the work that had been done by many parties to achieve the Government’s rejection of the Ford site.

36.  The Clerk updated members on the progress being made by the District Council to resolve the ongoing breach of planning control.

 

 

ARUN DISTRICT COUNCIL – DRAFT COMPLIANCE STRATEGY

 

37.  Members had before them and considered a report from the District Council on a proposed compliance/enforcement strategy it was proposing to adopt, subject to consultation with Town and Parish Councils (copy attached to minute book).

 

38.  Members welcomed the proposed policy document which they felt provided clarity on the approach of the District Council in dealing with unauthorised development and the procedures to be followed.   It was however considered that it would be helpful if more information could be given on the timescales and in particular on communicating with the complainant in the event of delays due to external factors.  For these reasons the Committee recommended that paragraph 28 be amended with the addition of the following paragraph:

 

‘Every effort will however be made to expedite procedures and avoid undue delay.  Where it is not possible to complete phase 4 within a 12 month timescale, the Council will be informed of the reasons for the delay as will the complainant(s).’

40. With reference to Planning Application Y/43/09/, the grounds for the objection were as follows:

 

i) The proposal to locate a barn in the south eastern corner of Maggie's Meadow is unneighbourly.  The siting of the building and the noise and smell associated with its operation so close to existing residential property is unacceptable.

ii) The land at this location is subject to flooding and is therefore unsuited for keeping livestock.

iii) The proposed earth berm will significantly increase the risk of flooding to adjacent residential properties.

iv) HGV movements in connection with the future operation of the site on the present narrow road give cause for concern on what is essentially an access track to Hoe Farm. There are also concerns for the safety of existing pedestrian, horse and cycle users of this access as there are no pavements or safe places of recess.

 

41. With reference to Planning Application Y/44/09/, the grounds for the objection were as follows:

 

i) Whilst supporting the principle of providing alternative power generation sources, the Committee has concerns about the intrusive nature of these particular wind turbines and the impact they will have on the rural landscape due to the size and height of the structures;

ii) The Parish Council is concerned that the noise generated by the turbines could be intrusive and cause disturbance to neighbours in this quiet rural hamlet.

 

 

42.  With reference to Planning Application Y/49/09/, the grounds for the objection were as follows:

 

i) Planning application Y/23/09 for a new garage with gymnasium over to replace the existing garage in the north east corner of the property was agreed conditionally on 22 May 2009. The new building was to be sited where the existing garage was located.

ii) Planning application Y/49/09 is for another new garage with gymnasium over in the south east corner of the property to replace the existing garage in the north east corner of the property. If Y/49/09 is agreed it is possible for two similar new structures to be constructed in the north east and south east corners of the property which would be overdevelopment at this location.

iii) For the reasons set out above, the Committee considered that if the Council was minded to agree this latest proposal, they should insist that only one new garage be built, either one in the north east corner of the site (in accordance with already agreed Y/23/09) or one in the south east corner in accordance with Y/49/09.
The Committee considered one replacement garage is reasonable for the site but two garages would be overdevelopment and unacceptable.
